I think that the HLP would have had to have a very long and serious talk about what to do. Its not hard to get an injunction, which is an order telling some one to stop (or start too) doing something, but I think it would have been very expensive to litigate it with Spanish defendants who probably dont have enough of what are called "minimum contacts" with any US jurisdiction.
But in the end it likely depends on what Mediteatro did. If they showed it once, for free, probably nothing. If they got a distributer and released it to every screen in Spain, they would for sure have sued. Something inbetween those options? The economics of the situation would have guided the HLP's hand.
In the end though, I think that the HLP thought that the real risk was to the movie that they are negotiating. So maybe they would have been more likely to sue. That is, as I have said before, the Golden Calf for the HLP these days, and is is worth more than any reprint rights all wrapped up together.
